General terms and conditions

The reservation of any of the trips offered by Mundoexplora implies full acceptance of the following general conditions. Mundoexplora undertakes to provide the information contained in these conditions together with the information relating to the trip contracted and any special conditions that may have been agreed, prior to the trip. For the interpretation, application or claim of the general and particular conditions, both the passenger and the organising agency expressly submit to the Courts of Valencia, renouncing any other jurisdiction.

1- Applicable legislation: The provision and acceptance of our travel services is governed by the provisions of Law 21/1995, of 6 July 1995, regulating Combined Travel and by the Regulations of Travel Agencies of the Valencian Community, Decree 20/97, of 11 February 1997 of the Valencian Government and other provisions in force.

2- Organisation: The technical organisation of most of the trips offered has been carried out by the Wholesale-Retail Travel Agency Mundoexplora, CV-Mm768-V, CIF B-97626394, with address at Calle Grabador Esteve, 15 Bajo, 46004 Valencia – Spain. If the contracted trip has a different organiser, this will be indicated to you in due course; in this case the relevant Terms and Conditions will be those of the organiser itself.

3- Prices:

3.1 – The prices indicated on our website and brochures are per person, do not include airfares, and are based on transportation fares, currency exchange rates, fees and taxes in effect on the date of the programme/brochure. The airfare shown is an average fare. Therefore, the prices on our website and brochures are merely a reference to the final price and do not necessarily correspond to the price of the contracted trip. All programme prices are subject to the air fares available at the time of booking and are therefore subject to change.

The specific quotes presented by Mundoexplora usually include flights on the specific date of travel, as well as airfares and are valid for as long as the airfares in question are in effect.

3.2 – Once a booking has been made, the price of the trip will not be modified upwards unless there is a substantial change in terms of exchange rates, transport rates, fuel costs, taxes or applicable taxes. In the event of a modification, you will be notified in writing or by any other means that allows a record of the communication made, being able, when the modification made is significant, to withdraw from the trip, accepting, if any, the corresponding penalties, or the modification of the contract. Under no circumstances will the price of a trip be revised upwards in the twenty days prior to the departure date, with respect to requests already made and confirmed with full payment for the trip.

3.3 – It is worth mentioning that prices are based on a minimum number of people travelling together, which will be informed in due course.In the event that the minimum number of people required is not reached, Mundoexplora may alter the price or cancel the activity; in both cases you may withdraw from the trip and be entitled to a refund of the total price or the amounts paid in advance, however, you may not claim any compensation beyond the amounts paid.

On the other hand, a group with more than the minimum number of people does not entail a reduction in the price, unless expressly stated otherwise.

4- Services included: The services included are those specified in the ancillary information provided by Mundoexplora. In case of modification of the circuit before departure, the services included and not included will correspond to the final information provided by Mundoexplora.

4.1 – In general all our programmes include:

  • Round trip transport, when this service is included in the contracted programme, with the type of transport, characteristics and category as stated in the information provided by Mundoexplora.
  • Accommodation, when this service is included in the contracted programme, in the establishment and with the dietary regime that appears in the information provided by Mundoexplora.
  • Fees and taxes for hotel establishments and indirect taxes where applicable.
  • Entrance fees to natural parks, museums and places of interest, when specified.
  • Telephone assistance during the trip, when this service is specifically included in the contracted programme.
  • On treks and mountain expeditions, all collective equipment (such as tents) when specified, as well as the necessary infrastructure. Permits are included only when specified.
  • All other services and complements that are specifically specified in the information provided by Mundoexplora.

4.2 – In general, none of our programmes include airport taxes, and/or entry and exit taxes, visas, vaccination certificates, drinks and personal extras, tips and, in general, any other service that is not expressly included. Excursions, extensions or optional visits not contracted directly with Mundoexplora at origin do not form part of the combined trip.

Most of the trips organised by Mundoexplora include travel assistance, accident and civil liability insurance, except in cases where expressly stated otherwise. For hiking and trekking programmes we recommend obtaining the Spanish Federation of Mountain and Climbing Sports (FEDME) card or taking out specific insurance that includes mountain rescue cover.

5- Registration: In order to formalise your reservation, you must pay 30% of the total amount of the contracted trip or the total amount of the flights. Regardless of the amount paid as a reservation, the payment of the same implies the acceptance of all the services included in the travel package offered, and therefore, the possible penalties that in case of cancellation, considered by the various service providers. For this reason, we strongly recommend that you take out cancellation insurance. Only after payment of the reservation is made, your place will be considered as firmly committed. The remaining amount of the total cost of the trip must be paid no later than twenty days before the departure date, otherwise your place may be cancelled and the conditions outlined in the ‘Cancellations’ section will apply.
There are trips that by their nature require special payment conditions, such as: cruises and crossings in Antarctica, Svalbard and Greenland, mountain expeditions and diving programmes. Mundoexplora will inform you in due course of the special conditions in these cases.

6- Transfers: You may transfer your reservation free of charge to a person who meets all the required conditions if you notify this in writing 30 days before the start of the activity, except in cases where the services of an airline company have been contracted and the latter does not accept a change of name. Both parties shall be jointly and severally liable to Mundoexplora for the payment of the balance of the price, as well as for any justified additional expenses that may have been caused by said transfer.

7- Refunds: Mundoexplora will not be obliged to refund for any services at the destination (hotels, transfers, excursions, etc.) that are not used due to flight delays or cancellations by the airlines. Nor in the event of strikes or other force majeure, or in the event that the non-use of these services has been voluntary, whatever the cause of non-use.

8 – Regulation 261/04 on denied boarding, cancellation or long delay of flights: When the Airline Company cancels a flight or incurs a long delay, it will be responsible for providing due assistance and care to the passengers affected, having to assume the costs of meals, calls, transport and overnight stay if necessary, in accordance with the provisions of EEC Regulation 261/04, which establishes common rules on compensation and assistance to air passengers in cases of denied boarding, cancellation or long delay of flights.

In case of flight cancellation, the Airline is also obliged to pay compensation to the passenger, as well as to reimburse the price of the air ticket if the passenger chooses this option. If the cancellation is due to extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken, the operating air carrier is not obliged to pay compensation but is obliged to provide appropriate assistance and care to the passengers concerned and to reimburse the ticket price if the passenger chooses this option.

9 – Cancellations: At any time you may cancel the services requested or contracted, having the right to a refund of the amounts you have paid whether it is the total price or a partial payment made, but discounting the following:

  • Any cancellation costs that may be incurred. These expenses correspond to the penalty charged by the airline company, which can in some cases reach 100% of the ticket, plus the expenses incurred to pay for the services at the destination and which cannot be recovered. The amount varies depending on how far in advance the cancellation is made, the services involved and the destination.
  • Plus, a penalty consisting of 5% of the total cost of the service if the cancellation is made more than 10 days but less than 15 days before the start of the activity; 15% between days 3 and 10, and 25% within 48 hours prior to departure.
    We recommend taking out cancellation insurance.

There are trips which, due to their nature, require special cancellation conditions, such as: cruises and crossings in Antarctica, Svalbard and Greenland, mountain expeditions and diving programmes. Mundoexplora will inform you of the special conditions in these cases. If you do not show up at the scheduled time for the service, you will not be entitled to any refund of the amount paid. In the case of air transport, we recommend boarding at the airport at least three hours before departure. In these cases, flight cancellation policies correspond to those indicated by the airline company. It is also considered a no-show if the intermediate days between the day of notification of the cancellation and the scheduled day of departure are holidays or weekends in Spain or the country of destination (because the cancellation request is not processed). Cancellations must be notified to Mundoexplora in writing in order to be considered firm cancellations. If, as a consequence of your cancellation, the group falls below the minimum number of participants, you will have to pay the necessary amount as a cancellation fee so that the rest of the participants registered for the same activity and date of departure can do it at the same price. If new registrations allow the minimum number of participants to be reached again, this condition will no longer apply.

10- Documentation: You must have your personal and family documentation in order, whether it be your passport or ID card, depending on the laws of the country or countries you are visiting. Some of these countries require visas, vaccination certificates, electronic entry authorisations or other types of documents for which you are responsible for obtaining. At the time of registration we will inform you of the general requirements for entry to the countries to be visited; however, it is your responsibility to verify with the embassy, consulate or the corresponding body, the need for particular documentation and requirements. Mundoexplora declines all responsibility in the event that any authority refuses to grant visas for particular reasons, or denies entry into the country due to a lack of the necessary requirements, a defect in the required documentation, or for not being the bearer of the same. Any expenses arising in any of these circumstances shall be borne by the passenger, and in this case the conditions and rules established for cases of cancellation or voluntary withdrawal of services shall apply.

11- Alterations: It may happen that Mundoexplora is forced to significantly modify some essential element of the programme after the contract has been formalised and before the departure date, in which case it may choose to terminate the contract without penalty on the part of the agency, or accept a modification of the contract in which the variations introduced and their repercussion on the price will be specified. The penalties applied by the airline company will not be assumed by Mundoexplora as it has no control over them. You must inform us of your decision within 3 days, otherwise we will understand that you choose to terminate the contract.
The same applies in the event that Mundoexplora has to cancel the activity after the contract has been formalised and before the departure date, for any reason beyond your control and not justified by sufficient reasons or force majeure.

If, once the activity has begun, Mundoexplora finds that it is unable to provide a significant part of the services foreseen in the contract, we will adopt other suitable solutions for the continuation of the activity, without any supplement to the price and, where appropriate, we will pay you the amount of the difference between the services foreseen and those provided. If the solutions adopted are unfeasible or if you do not accept them on reasonable grounds, we will facilitate your return to the point of origin by an equivalent means of transport, reimbursing you the amounts that correspond to you proportionally. When the cancellation of a service in any of the above cases is due to force majeure, adverse weather conditions or sufficient causes, there will be no obligation for Mundoexplora to compensate the traveller and the additional costs involved in these new conditions will be borne by the traveller. Changes in the order of the itinerary offered do not alter the conditions of the programme, as long as the complete itinerary is followed. Changes in the programme due to adjustments in the airline timetable or delays in means of transport shall not be considered as alterations to the services. In itineraries that run in areas that are difficult to access, especially those in high mountains, it will not be considered an alteration in the services if the highest or furthest point planned is not reached, either due to adverse weather conditions, because the group as a whole does not meet the necessary physical/technical conditions, due to the deterioration of communication routes, mechanical breakdowns or for any reason that we think may be detrimental to your own safety. If you unilaterally decide to change the itinerary at the destination without being previously notified to or authorised by Mundoexplora, Mundoexplora will not be held responsible for any possible problems that may arise in the subsequent development of the travel programme. For this reason Mundoexplora provides information on emergency telephone numbers at the destination and in Spain (24 hour service).

12- Responsibility: Mundoexplora undertakes to carry out all the services contained in the programme contracted, regardless of whether they are to be carried out by the same company or by other service providers – without prejudice to our right to take action against said service providers – and always within the limits established in the applicable legislation. This obligation shall be waived when the defects in the execution of the contract are attributable to the contracting party or when there are force majeure causes, i.e. circumstances beyond the control of the party invoking them, abnormal and unforeseeable, the consequences of which could not have been avoided despite having acted with due diligence; or when the defects are due to an event that Mundoexplora could not foresee or overcome. Mundoexplora shall not be liable for accommodation, meals, transport or other expenses arising from delays in departures or returns of means of transport due to weather, technical reasons, strikes or other force majeure. With regard to luggage, Mundoexplora accepts no responsibility for any damage or deterioration that may occur during the trip. With regard to air transport, we refer you to the airlines’ own conditions.
Mundoexplora’s liability will be limited to a maximum of the total amount actually paid for the services of the trip.

13 – Other considerations: In the case of activities related to mountain sports, you must take into account that to a greater or lesser extent, they always require adequate physical conditions. Furthermore, some of them, specifically climbing, via ferrata, canyoning, mountain skiing, hiking and mountaineering, entail a risk in themselves and can become dangerous due to the fact that they take place in a natural environment subject to changing and unpredictable weather conditions. Although at Mundoexplora we will inform you of the technical difficulties and requirements necessary to participate in our programs, it is your responsibility to evaluate whether you are qualified to carry them out, both in terms of your physical fitness and your technical capacity and experience. Furthermore, some trips take place in countries where it is not possible to find the same customs, comforts or hygienic conditions to which you may be accustomed. Although at Mundoexplora we will inform you of the characteristics of the country where the program you have chosen will be developed, it is your responsibility to evaluate your adaptation capabilities, accepting and respecting these differences and assuming possible discomforts.
If any breach occurs in the execution of the contract, the traveler is obliged to immediately report it, preferably to the emergency telephone number informed by Mundoexplora, or failing that, to our local collaborator at the destination, in addition to expressing it in writing as soon as possible, or in any other way that is recorded by Mundoexplora.
